موارد عذر موجه در عدم اجرای تعهدات در قراردادهای هوشمند از منظر حقوق ایران و فقه اسلامی

چکیده مقاله :
قراردادهای هوشمند، به عنوان نسل نوینی از قراردادها که بر بستر فناوری دفترکل توزیعشده_بهویژه بلاکچین_ پیادهسازی میشوند، بهدلیل برخورداری از ویژگی خوداجرایی، بهعنوان ابزاری برای تضمین اجرای تعهدات معرفی شدهاند. نوشتار حاضر با روش توصیفی_تحلیلی به بررسی این پرسش اصلی می پردازد که چه مصادیقی از نقض موجه تعهد در قراردادهای هوشمند قابل شناسایی است؟ یافتههای پژوهش نشان داد که قراردادهای هوشمند، علیرغم خودکار بودن در اجرا، همچنان در معرض موانع فنی، حقوقی و اقتصادی قرار دارند و در نتیجه، امکان نقض تعهد در آنها منتفی نیست؛ امری که حاکی از آن است که خوداجرایی، تضمین مطلق اجرای تعهدات به شمار نمیآید. نتیجه پژوهش آن بود که قواعد عمومی «تعذّر» و «تعسّر» در حقوق ایران، با ابتنا بر مبانی فقه اسلامی، ظرفیت لازم برای توجیه عدم اجرای تعهد در قراردادهای هوشمند را دارا هستند. با این حال، فقدان مقررات خاص ناظر بر این نوع قراردادها، ضرورت توجه قانونگذار به تدوین قواعد اختصاصی در این حوزه را آشکار میسازد.
Smart contracts, as a new generation of contracts implemented on the platform of distributed ledger technology_particularly blockchain_have been introduced as a tool for guaranteeing the performance of obligations due to their self-executing feature. This study, adopting a descriptive_analytical method, examines the central question of which instances of justifiable non-performance of obligations can be identified in smart contracts. The findings indicate that, despite the automated execution of smart contracts, they remain exposed to technical, legal, and economic obstacles, therefore, the possibility of non-performance cannot be ruled out, indicating that self-execution does not constitute an absolute guarantee of performance. The study concludes that the general doctrines of "impossibility" and "Impracticability" in Iranian law, grounded in Islamic jurisprudence, possess sufficient capacity to justify non-performance in smart contracts. However, the lack of specific regulations governing such contracts highlights the need for legislators to develop specialized rules in this field .Nevertheless, the absence of specific regulations governing such contracts highlights the need for legislative attention toward the formulation of specialized legal rules in this field.
